Thomas Participates in High-Stakes Case Despite Calls for Recusal

WASHINGTON (AP) - Justice Clarence Thomas has returned to the Supreme Court bench after a brief hospitalization. Thomas, 73, was admitted to Sibley Memorial Hospital in Washington, D.C., on Sunday with an infection. He spent the night in the hospital but was discharged on Monday and is now back at home recovering.

Thomas missed oral arguments in two cases on Monday, but he participated in the court's conference on Tuesday and is expected to participate in the remaining cases on the argument calendar this week.

The court did not disclose the nature of Thomas' infection, but he has had health problems in the past. In 2019, he was hospitalized for a urinary tract infection and gallstones. He also has a history of asthma.

Thomas' return to the court comes amid calls for him to recuse himself from a high-stakes case over whether former President Donald Trump has presidential immunity from being sued for actions he took while in office. The case is scheduled to be argued before the court on January 6, 2023.

Critics say Thomas should recuse himself because his wife, Virginia "Ginni" Thomas, was a vocal supporter of Trump and has been subpoenaed by the House Select Committee investigating the January 6, 2021, attack on the U.S. Capitol.

Thomas has not publicly commented on the calls for him to recuse himself.
